Event & Gala Photography – Terms of Service

By purchasing, booking, or otherwise engaging photography services from Connor Brady Photography(“Photographer”), the Client agrees to the following Terms of Service. These terms are intended to function as a binding agreement and may be included in a product description, invoice, or booking page. By purchasing this service, you acknowledge that you have read, understood, and agreed to all terms below.

1. Services Provided

Connor Brady Photography agrees to provide professional event and/or gala photography services as described in the purchased package or written agreement, including but not limited to:

• Event coverage during the agreed-upon time frame
• Candid and posed photography at Photographer’s discretion
• Professional post-processing and color correction

Specific deliverables (number of images, coverage hours, add-ons) are determined by the package selected at checkout or in writing.

2. Booking & Payment

• A booking is not confirmed until the required deposit or full payment is received.
• Deposit: A non-refundable deposit of 50% of the total fee is due at the time of booking.
• Accepted payment methods include cash, check, website purchase, or bank transfer.
• Remaining Balance: Any remaining balance is due prior to the event date or before delivery of final images, whichever comes first.
• Late Payments:
  • A $100 late fee will apply to payments overdue by more than 7 days.
  • Payments more than 14 days late may incur an additional 10% interest on the overdue balance.
• Failure to make timely payments may result in delayed image delivery or cancellation of services.

3. Cancellations & Rescheduling

Client-Initiated Cancellation

• If the Client cancels more than 14 days before the event:
  • The 50% deposit is retained; no further payment is required.
• If the Client cancels within 14 days of the event:
  • Client owes 40% of the total contract price, in addition to the deposit.
• If the Client cancels within 3 days of the event:
  • Client owes 50% of the total contract price, in addition to the deposit.

Photographer Cancellation

• If Connor Brady Photography is unable to perform due to illness, emergency, or unforeseen circumstances, all payments will be refunded.
• Best efforts will be made to assist in locating a replacement photographer, but this is not guaranteed.

4. Event Conditions & Cooperation

• Client agrees to provide reasonable access, space, and conditions for photography.
• Photographer is not responsible for missed shots due to:
  • Event delays or schedule changes
  • Venue restrictions
  • Interference by guests, staff, or other vendors
  • Poor lighting or environmental limitations

5. Artistic Discretion & Revisions

Client acknowledges that photography is a creative service and agrees to trust the Photographer’s artistic judgment regarding image selection, composition, and editing style.

• The service includes up to one (1) round of revisions on delivered, edited images.
• Additional revision rounds may be billed at an additional fee.
• Requests that substantially alter the Photographer’s established style may be declined.

6. Image Delivery

• Images will be delivered digitally via an online gallery unless otherwise specified.
• Delivery timeframe is typically 2–4 weeks, depending on event size and season.
• Unedited or RAW files are not provided.

7. Copyright & Usage Rights

• All images remain the copyrighted property of Connor Brady Photography.
• Client is granted a non-exclusive, non-transferable license to use delivered images for:
  • Personal use
  • Event promotion
  • Marketing and social media

Images may not be sold, altered, or used for commercial resale without written permission.

8. Photographer Promotion

Client grants permission for the Photographer to use selected images for:

• Portfolio display
• Website and social media
• Marketing and promotional materials

If confidentiality is required, it must be requested in writing prior to the event.

9. Liability & Limitations

• Photographer is not liable for circumstances beyond reasonable control including weather, venue restrictions, equipment failure, or acts of God.
• Liability is limited to the amount paid for services.
• Client releases the Photographer from any claims related to dissatisfaction with appearance, missed moments, or event outcomes.

10. Force Majeure

Neither party shall be held liable for failure to perform due to causes beyond reasonable control, including but not limited to natural disasters, government restrictions, or emergencies.

11. Governing Law

This agreement shall be governed by and construed under the laws of the Commonwealth of Pennsylvania.

12. Agreement Acknowledgment & Acceptance

By purchasing, booking, or otherwise engaging Connor Brady Photography services, Client expressly acknowledges and agrees that:

• This document constitutes a legally binding agreement.
• Client has had a reasonable opportunity to review these Terms of Service.
• Client’s purchase, payment, or acceptance of services constitutes clear and affirmative acceptance of all terms contained herein.

This agreement is intended to function as a clickwrap / purchase-based contract, enforceable to the fullest extent permitted by law.
